Transsexual to challenge surgery ban

A TRANSSEXUAL who wants to end the “nightmare” of being “a female in a male body” has won permission to bring a legal challenge against a health authority’s refusal to pay for a sex change operation. It is the first case of its kind to go before the High Court.

Mr Justice Tucker yesterday ordered an urgent hearing of an application for judicial review by W, an unemployed 30-year-old, who cannot be named for legal reasons, against Gloucestershire Health Authority.

Stephanie Harrison, appearing for W, who is legally-aided, told the judge that the test case raised important issues as to whether health authorities were entitled to refuse NHS funding for all “gender reassignment” surgery.
