This paper will address the relationship between transsexuality and citizenship in contemporary Argentina, considering the historical period between the re- establishment of democratic governments in 1983 and the election of President Kischner in 2003.

That relationship will be examined through a particular focus on a special field of construction of ethical and political subjectivities: legal discourse. The principal hypothesis to be developed is that transsexual subjects are constructed within the different discourses (and therefore performativities) of the Law in ways that imply a seriously damaged transsexual citizenship, considering especially sexual and reproductive rights. Adding a theoretical framework from Arendtian and Derridean conceptualizations of foreignness and otherness, this damaged transsexual citizenship will be also interpreted from a human rights perspective.
