Sex change man wins right to sue StateA RUSSIAN, who was registered as a female when given temporary permission to remain in this country in 1996, later had a sex change and married a German woman here, the High Court was told yesterday. Nicholas Krivenko (28) and his wife Sybille Hintze-Krivenko (50) were given leave to take judicial review proceedings against the Irish authorities over an alleged failure to extend his residence permit. The couple, who live in Broadford, Co Clare, are suing the gardai, the Minister for Justice, Equality and Law Reform; the Attorney General and Ireland. They are seeking an order requiring the gardai to issue a registration certificate and to amend his passport. Peter Finlay SC, with Richard Humphreys BL, for the applicants, said they ran a kennel business and also had property and their own house. There was absolutely no dependence on the State. In an affidavit, Nicholas Krivenko said he was born in what was then the USSR and registered as a female on his birth certificate with the Christian name of Nadia. He came here in November 1996 together with Ms Hintze-Krivenko, and they have stayed here on a temporary permit. In 1995 he began a hormone therapy course to reassign his gender to male, changing his name to Nicholas and marrying Ms Krivenko in a Limerick registry office 13 months ago. He has not been granted a registration certificate by the gardai and his solicitor has been notified that the State is inquiring into the validity of his marriage.
