Lorely Burt MP (Solihull, LibDem) asked the minister whether the basis of protections in goods and services presently being considered (see Col 6W of 9 Oct 2006) would be extended beyond gender reassignment to cover protection on the basis of gender identity.

The minister replied that this was being considered within the Discrimination Law Review.

This has been a matter which Press for Change have regularly questioned in recent years. By definition “gender reassignment” protections require intent to undergo, be undergoing or have undergone in the past a process under medical supervision (see s.82(1) of Sex Discrimination Act 1975). No other group is protected on the basis that they need to enter into a process to obtain primary protections in law; all others are protected on the basis of some inherent characteristic of themselves or some fundamental belief.

We will be watching closely as the Discrimination Law Review makes its deliberations known.

Conditions of Employment: Gender Identity Disorder

Lorely Burt: To ask the Secretary of State for Trade and Industry whether he plans to introduce general employment protection on the grounds of gender identity in addition to protection for those who seek or who have had gender reassignment surgery. [118338]

The Government are considering this issue as part of the Discrimination Law Review.
